กฎหมายทำแท้งในกรณีที่มารดามีปัญหาทางจิต

การทำแท้งตามประมวลกฎหมายอาญามาตรา 301 บัญญัติว่าเป็นความผิดและกำหนดโทษไว้ แต่ได้บัญญัติเป็นข้อยกเว้นถึงเหตุที่จะทำแท้งโดยไม่ผิดกฎหมาย ต้องเป็นการกระทำโดยแพทย์เท่านั้น เนื่องจากกรณีสุขภาพของหญิง หรือหญิงนั้นมีครรภ์เนื่องจากถูกข่มขืน ตามมาตรา 305 แต่กฎหมายดังกล่าวมุ่งพิจารณาเฉพาะความจำเป็นเฉพาะสุขภาพกายเท่านั้น หากหญิงมีปัญหาสุขภาพจิตซึ่งในบางโรคอาจทำให้เกิดปัญหาไม่น้อยไปกว่าสุขภาพกาย อีกทั้งอาการทางจิตที่เกิดขึ้นอาจรุนแรงถึงตัวหญิงเอง หรือตัวทารกที่เกิดขึ้นมาก็ได้ แต่กฎหมายอาญาของไทยไม่ได้ขยายความไปถึงปัญหาทางจิต ซึ่งอาจทำให้แพทย์ผู้ตัดสินใจทำได้รับโทษทางอาญา
ดังนั้นงานวิจัยฉบับนี้ได้ศึกษาข้อมูลในต่างประเทศ เช่น ประเทศเยอรมัน สหรัฐอเมริกา อังกฤษ เป็นต้น เพื่อนำข้อมูลที่ได้มาเสนอเป็นร่างกฎหมายการทำแท้งในกรณีที่มารดามีปัญหาทางจิต เพื่อแก้ไขปัญหาดังกล่าว โดยจัดทำเป็นร่างเพื่อแก้ไขประมวลกฎหมายอาญา และข้อบังคับแพทยสภา พร้อมทั้งสำรวจความพึงพอใจต่อร่างกฎหมายดังกล่าว จากทั้งผู้ที่เกี่ยวข้องกับกฎหมายการทำแท้งโดยตรงและโดยอ้อม เพื่อให้สามารถนำมาบังคับใช้ได้จริง

An abortion in according to Section 301 of the Penal Code is a crime and shall be punished. Nevertheless, Section 305 prescribed that an abortion committed by a medical practitioner for the sake of the health of such woman; or for the reason that a woman is pregnant on account of the commission of the offense, such abortion can be done legally or the offender is not guilty. The purpose of Section 301 and 305 is only aim to protect the woman who has physical problem. However it is not only physical problems that the law should allow an offender to procure abortion but the law should also allow a woman who has mental problem to procure abortion, as well. Since mental problem also cause problems to both a mother and a new born child. Thai law does not cover the case that mother has mental problem, if a doctor decide to commit an abortion for that woman, he shall be punished.
Thus, this research is aim to solve the problem of an abortion in the case that a mother has a mental problem by studying the data from many countries such as Germany, USA and UK. This research is comprising of a draft of the amendment of the Penal Code and the amendment of the rules and regulation of the Medical Council. This research also surveyed the satisfactory of both direct and indirect people who relevant to an abortion in order to make this law worked well in practice.
