การแปรรูปเรือนจำในประเทศไทย

การศึกษาเรื่อง “การแปรรูปเรือนจำในประเทศไทย” มีวัตถุประสงค์เพื่อศึกษาแนวคิดและทฤษฎีการบริหาร รูปแบบ วิธีการ ปัญหา และอุปสรรค์ ในการให้เอกชนเข้ามาดำเนินการแปรรูปเรือนจำ และเพื่อแสวงหาความเป็นไปได้ ในการดำเนินการเรือนจำเอกชนในประเทศไทย ปัญหาสำคัญอันเนื่องมาจากปริมาณยอดผู้ต้องขัง ที่กระทำความผิดเพิ่มมากขึ้นและเข้าสู่เรือนจำเป็นจำนวนสูงขึ้น เรือนจำจึงมีผู้ต้องขังมากเกินกำลังที่จะรับได้ เป็นภาระกับงานราชทัณฑ์ไม่สามารถบริหารจัดการงานบังคับโทษได้ตามวัตถุประสงค์ และส่งผลกระทบด้านต่างๆ เช่น งบประมาณ สถานที่ บุคลากร เป็นต้น เรือนจำหลายแห่งมีจำนวนผู้ต้องขังจำนวนมากเกินกว่าที่ยอมรับได้ในระดับสากล ที่จะสามารถดูแลได้อย่างทั่วถึง และมีประสิทธิภาพ และจากการศึกษาข้อเท็จจริง ข้อกฎหมาย จากสภาพปัญหาที่เป็นข้อมูลด้านเอกสาร และการสำรวจข้อมูลโดยออกแบบสอบถามทำให้เห็นสภาพปัญหาข้อเท็จจริงที่เกิดขึ้น ข้อมูลในต่างประเทศ พบว่า เอกชนได้เข้ามามีบทบาทในการบริหารจัดการเรือนจำอย่างแพร่หลาย โดยเฉพาะในสหรัฐอเมริกา ออสเตรเลีย อังกฤษ และแคนนาดา
ผู้วิจัยมีข้อเสนอแนะในเรื่องการแปรรูปเรือนจำในประเทศไทยที่ได้ศึกษามาดังกล่าว เช่น การแปรรูปเรือนจำ ให้เอกชนเข้ามาดำเนินการ อาจเป็นกรณีการร่วมลงทุนระหว่างรัฐกับภาคเอกชน หรือให้เอกชนเข้าดำเนินเรือนจำทั้งหมด หรือให้ภาคเอกชนดำเนินการเฉพาะบางส่วนงานก็ได้ โดยมีการควบคุมดูแล และกำกับโดยภาครัฐผ่านกรมราชทัณฑ์ มีการกำหนดมาตรา และมาตรฐานต่างๆ ได้อย่างชัดเจน เป็นต้น

The study of “ privatization of Jails in Thailand” was aimed at investigating the concept and theories of management , models, approaches, problems and obstacles in allowing the private sector to privatize jails and seeking for the possibilities of managing of private prisons in Thailand. The major problem is due to an increasing number of prisoners. Therefore, there are too exceeding number of prisoners for jails to accommodate them. it is a huge burden for the Department of Corrections to operate as the objectives stated. This results in impacts in various aspects. For example, budget , place, personnel, etc. Many jails accommodate exceeding number of prisoners which is more then what is accepted at the universal level so that all prisoners can be properly and effectively taken care of. From studying facts, laws, documentary research as well as a survey by using queshonnaire ,this research reflects the problems actually emerge. The date from the studies abroad indicated that the private sector has played an essential role in managing jails, especially the U.S.A . , Australia , the United Kingdom and Canada.
The researcher suggested the privatization of jails in Thailand. That is , the private sector should be allowed to manage jails this can be the joint venture between the government and the private sector or the private sector will manage all the prisons in Thailand. The operation and supervision will be performed by the public sector through the Department of Corrections, legal sections and standards should be clearly stated.
